Alternative Dispute Resolution or (“ADR”) refers to a variety of processes that assist parties resolve their disputes without going to court. In comparison to the traditional court proceedings, the ADR process is faster, less expensive and offers a higher degree of confidentiality. The parties themselves are involved in the process and are able to shape the proceedings to a great extent (e.g. language, seat of arbitration, applicable law and the selection of the arbitrator). Most significantly, the ADR process creates an environment for the parties to maintain their ongoing relationship with each other.
