A compliance monitoring programm (CMP) is a tool that allows the top management to have control over the regulatory risk in a company. Legally it's supported by the Swiss Code of Obligations, by Basel II and ISO normes. SOX as well as most Corporate Governance documentation require and support a performing CMP. But what is a CMP? The general objective of a compliance process in terms of an internal control system (but not limited to statements of income) is the respect of law and regulation and as well as maintaining high ethical practices in any kind of organization. The objectives are of three kinds: minimizing risk, optimizing processes, improving efficiency. As a reminder, we note that the term "compliance" in English means respect of the underlying business with a set of standards within an organization. These standards may be of regulatory or contractual basis. They can also be a source of self-regulation. You have to imagine a mirror between operational activity and regulatory standards. The ultimate goal is that the gap between the normative system and the operational activity is as low as possible. It includes all sectors and workflows and covers all companies in an organization and all laws applicable.
