تأسس مصرف الضمان الإسلامي، في شكل ( شركة مساهمة ليبية ) بناءً على قرار مجلس إدارة الشركة الضمانية القابضة رقم (17) لسنة 2019م، القاضي بتأسيس مصرف الضمان الإسلامي عملاً بنص المادة ( 99 ) من القانون رقم 23 لسنة 2010م، بشأن النشاط التجاري و يكون رأس ماله مملوكاً بالكامل للشركة الضمانية القابضة المنشأة بقرار مجلس الوزراء رقم ( 456 ) لسنة 2016 التابعة لصندوق الضمان الاجتماعي، و يكون للمصرف الشخصية الاعتبارية و الذمة المالية المستقلة ويلتزم بممارسة أنشطة الصيرفة الإسلامية، وفقاً لأحكام القانون رقم (1) لسنة 2005م، وتعديلاته الواردة في القانون رقم (46) لسنة 2012م ، بشأن المصارف، وقانون النشاط التجاري، والقرارات واللوائح والتعليمات الصادرة بمقتضاه.
