When it comes to estate planning, there is no such thing as a one size fits all. The complexity of the plan depends on our clients’ estates and their estate planning goals. When we prepare a Will or Trust for our clients, we also include a Durable Power of Attorney and an Advance Directive. Additionally, when parties have us prepare a trust as part of their estate plan, we also include a Certificate of Trust and a Pourover Will. Often people feel that they do not need to worry about estate planning if they do not have a large estate. However, everyone can benefit from an estate plan. For instance, parents of young children are often terrified of the thought of someone else caring for their children who they have not chosen. Yet, if they do not have a Will or Trust in place naming a guardian, then they do not have a voice in that decision.
