In 2016 Massachusetts legalized recreational marijuana use by people 21 and over (so-called “Adult-Use’”) and created a state agency called the Cannabis Control Commission to regulate businesses in the Adult-Use industry. In 2018, the issued regulations (935 CMR and began issuing Adult-Use business licenses. Five types of businesses - cultivators, manufacturers, retailers, craft cultivator cooperatives, and testing facilities - are currently eligible to apply for Adult-Use licenses in Massachusetts, and delivery services and places of local consumption (like bars or cafes) will be next. The Adult-Use regulations require licensed businesses to develop, implement, and maintain detailed operating procedures covering topics including things like security, inventory control (including seed-to-sale tracking), storage, record keeping, quality control, diversion prevention, and emergency procedures. Licensed Adult-Use businesses are also required to provide at annual training to certain executives, employees, consultants and contractors, as well as to participate in a Responsible Vendor program delivered by an independent, accredited provider. If a licensed Adult-Use business fails to comply with its duty to maintain adequate operating procedures or training requirements, the can suspend, revoke, or refuse to renew its license.
