İşte bu tutum ve çabayı gösteren adalet, özne (süje) ile ilgili oluşundan ötürü öznel (sübjektif) adalet olarak nitelenir. Bir erdem olan öznel adaletin dışında ve ondan önce nesnel (objektif) bir adalet kavramı vardır. Nesnel adalet, kişinin bir özelliğini değil, kişilerin somut durumlarda gerçekleştireceği ilişki biçiminin bir özelliğini deyimler. İşte hukuk alanında hukuki değer olarak söz konusu olan adalet de, bu nesnel anlamda adalettir. Çünkü hukuk, insanlar arası ilişkileri biçimlendiren, onlara görünür ve algılanabilir bir düzen veren, bu amaca yönelen normlar bütünüdür.” Toplum içindeki davranış ve ilişkilerin değerlendirilmelerini içeren kurallar bütünü olarak hukuk, bu değerlendirmelerde adalet ölçüsünü kullandığı ve kullanmak durumunda bulunduğuna göre, adaletin böylece, hukukun da bir değerlendirilme ölçüsü olacağı doğaldır. Hukuk normlarında adalet acaba ne ölçüde yansıtılmıştır? Mevcut hukuk ne denli adaletlidir? İşte burada yasa üstü adalet kavramı ortaya çıkmaktadır. Bu, tüm hukuk sistemine ve sistemlerine egemen bulunan, nesnel ve salt bir değer niteliğindeki adalettir. Hukuk bir toplum düzenini içerir. Hukukun varlık nedeni de adalettir; gerek mevcut düzeni korumak, gerekse onu değiştirmeyi meşrulaştırmak için her zaman adalete başvurulur. Nesnel ve yasa üstü adalet hukukta karşımıza kurulu hukuk düzenlerinin asli örneği, olması gereken hukuk anlamında hukuk idesi olarak çıkar. Bu niteliği ile adalet, mevcut hukuk düzenlerinin kendisine uygun olup olmadığı açısından bir değer ve değerlendirme ölçüsü olur. Yine bu özelliği ile adalet, aynı zamanda hukukun idealidir. Hukukun gerçekleştirmek amacını güttüğü şey adalettir.
