About Ben Witmer

My professional career began as a high school math teacher after obtaining dual degrees in secondary education and mathematics. After teaching for a period, I decided to pursue my law and MBA degrees and began practicing law as a general practice litigator in 2002. For the next 20 years, I assisted individual and business clients in various areas of law, including business dispute resolution and litigation, real estate transactions, and other general litigation. During that phase of my career, I realized that in the vast majority of legal matters, other than the lawyers, there is no winner. While prepared for litigation, my energy and focus were always on avoiding and/or resolving disputes - realizing that conducting a cost-benefit analysis of a pending dispute is integral to making efficient, non-emotional decisions, and assisting clients. As time passed, and the legal climate changed, civility and collaborative problem-solving became less ubiquitous and it became more difficult to achieve a successful “finished product” by utilizing the legal process. I became disenfranchised with the general practice of law and thought about the areas practice which remained enjoyable where problem-solving and collaboration toward a mutual goal still thrived and arrived at the real estate transactional process. Buyers, sellers, agents, lenders, and attorneys all have the same goal – a successful conclusion to the buy-sell transaction. I decided to focus my practice on real estate transactional work which allowed me to truly assist all parties toward a successful outcome. With that goal in mind, I decided to explore the neutral role in the transactional business of title attorney/agent. I joined a regional title company and learned the behind-the-scenes title process to achieve a smooth and stress free transaction for buyers and sellers. Unfortunately, during this phase I experienced the shortfalls in communication and customer service that were prevalent in the industry, often leaving agents, buyers, and sellers frustrated and feeling out of the loop. With correcting these inadequacies in mind, in late 2022, I made the decision, with a trusted colleague who shared the same proactive, communicative approach to her transactional title practice, to venture out on our own. Encore Land Service’s goal is to provide the hustle, so the parties don’t experience the hassle. We enjoy what we do, gathering and assembling the puzzle pieces to accomplish a smooth, stress-free transaction from start to finish.
