About Brandon Brigham

I represent employers in the defense of Occupational Safety and Health Administration (OSHA) citations and the full range of employment-related claims. I have defended employers in trials regarding whistleblower, retaliation, and wrongful termination claims, as well as workplace safety citations issued by federal OSHA plans, Michigan OSHA, Kentucky OSHA, and all other East Coast state OSHA plans. I also counsel companies on workplace health and safety matters, including worksite investigations, compliance, and safety and health procedures and plans. In addition to this litigation practice, I counsel clients on a variety of employment issues, including decisions regarding adverse employment actions, harassment, retaliation, and compliance with state and federal employment laws such as the Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), and New Jersey Law Against Discrimination (NJLAD). I also have investigated and defended against citations in virtually every industry, including warehousing, utility, pipeline, construction, manufacturing, and retail. I have handled every stage of defending employers against OSHA, from representing employers throughout the initial inspection to trials and appeals. I am proficient in handling OSHA-related appeals before the OSH Review Commission and state and federal appellate courts and develops novel arguments when necessary. My trial experience includes opening and closing presentations, preparing witnesses to give testimony, examining witnesses, and preparing and opposing pre- and post-trial motions, and other submissions. I also represent companies in a range of employee benefit litigation matters, including Employee Retirement Income Security Act (ERISA) class actions. My experience includes defending class action claims challenging denial of benefits as well as the administration of 401(k) savings plans. I also have experience litigating unfair competition matters on behalf of pharmaceutical, retail, and financial services clients. Finally, I have a strong commitment to pro bono work. I earned his J.D, summa cum laude, from Villanova University School of Law in 2009, where I was named to the Order of the Coif, received the ABA-BNA Award for Excellence in the study of Labor and Employment Law, and served as a managing editor of the Villanova Law Review. I earned my B.A. in philosophy from Pennsylvania State University in 2003, where I graduated Phi Beta Kappa.
