About Brian Levey

I am a land use attorney in the Boston, Massachusetts office of Beveridge & Diamond, a national law firm concentrating in project development, environmental law and litigation. My practice focuses on assisting real estate developers, non-profit institutions, builders and property owners in obtaining land use and environmental permits and approvals from local boards (Planning Boards, Zoning Boards, Conservation Commissions or Boards of Health) and state agencies (Department of Environmental Protection) to build non-profit, residential, and industrial projects. With over 25 years of experience, I have appeared before numerous local boards, commissions and committees throughout Massachusetts. I have developed a network of excellent working relationships with members of local boards, town planners, conservation and health agents and Town Council and City Solicitors across the Commonwealth. I occasionally serve as special counsel to municipal boards or counsel to neighborhood associations. When necessary, I also handle permit appeals in trial courts (Massachusetts Land or Superior Court or the U.S. District Court for Massachusetts) and appellate courts (Massachusetts Appeals Court and Supreme Judicial Court and the U.S. First Circuit Court of Appeals). My courtroom experience also includes handling a variety of real estate matters including disputes over boundaries, easements, rights of way, restrictions or other interests in land. I also have litigated adverse possession, quieting title, registration, breach of contract, specific performance, and nuisance cases. Representative cases also include regulatory takings and determinations of the validity of zoning amendments.
