About Casper Struve

I advise on intellectual property rights, with a particular focus on litigation support in legal proceedings concerning patents. Over the years I have supported numerous cases involving both infringement and validity gaining substantial experience in understanding complex, highly technical matters and presenting them in clear, straightforward arguments. In addition, I have extensive experience handling opposition and appeal proceedings before the European Patent Office (EPO), which has become a significant part of my practice. Since 2013 I have served as a Technically Qualified Judge (external member) at the Danish Maritime and Commercial Court, where I am appointed to patent cases on an ad hoc basis. In 2023 I was further appointed as a Technically Qualified Judge (external member) to both the Danish Eastern High Court and the Danish Western High Court. Furthermore, I am listed as a court appointed expert that the Association of Danish Intellectual Property Advisors (ADIPA) may suggest to the Danish Courts in patent litigation cases, where it is essential that the expert has knowledge of both patent law and the technical area of the patent-in-suit. Beyond litigation support and opposition and appeal work, I have also worked with drafting and prosecution of patent applications, mainly before the European, Danish and Finnish Patent Offices. Another area in which I have substantial experience is supplementary protection certificates for medicinal products and SPC extensions based on the paediatric regulation. I have had the opportunity to advise both Danish and international businesses, with a particular focus on the fields of chemistry, life sciences, and pharmaceuticals.
