Serves as in-house legal counsel to Erie 1 BOCES, providing legal advice and representation on a wide variety of legal matters with a focus on Labor and Employment. Responsible for the direction, coordination and provision of all Labor Relations and Policy Services to school districts across New York State. Includes supervision of all division staff. Provides advice and assistance to school superintendents, assistant superintendents and other school administrators across Western New York on a variety of labor and employment, contract, and education law matters. Includes representation of school district leadership in all aspects of employee and labor relations matters. Routinely serves as chief negotiator for school districts in collective bargaining with all types of employee unions – teachers, administrators, clerical staff, buildings and grounds, transportation, nurses, etc. Negotiates and drafts service contracts with third-party providers and municipalities pursuant to GML. Provides representation to school districts during the contractual grievance/arbitration process, as well as a variety of administrative proceedings before the Public Employment Relations Board, Division of Human Rights, and Equal Employment Opportunity Commission. Performs employee investigations, offers recommendations for resolution and assists with all aspects of human resources and personnel matters including but not limited to hiring, evaluation, accommodations/leaves, discipline and termination. Acts as hearing officer for employee termination hearings pursuant to Civil Service Law §§71, 73 & 75. Also serves as hearing officer for student disciplinary proceedings pursuant to NYS Education Law §3214. Provides representation to school districts in termination hearings pursuant to Civil Service Law §75. Routinely provides professional development training and presents on a wide variety of Human Resources, Labor and Employment, and Education Law topics.
