Eric S. Roth counsels medical device and pharmaceutical company clients in a variety of areas, including negotiating and documenting commercial transactions such as supply, licensing, distribution and strategic alliance agreements with external suppliers, original equipment manufacturers, competitors and strategic partners; providing general counsel to company management on issues relating to regulatory and corporate compliance, litigation strategy, general commercial matters, pricing and contracting strategies, product liability, and health care compliance issues; negotiating and documenting domestic and international commercial contracting activities relating to non-inventory capital procurement, supply chain management, clinical trials, consulting agreements, marketing alliances, and grant arrangements; developing corporate governance policies and conducting internal investigations to ensure compliance with corporate policies and procedures. Eric is also a Shareholder in the Labor and Employment Department of the law firm of Stearns Weaver Miller. He counsels clients on FMLA, FLSA, ADA and ADEA matters and compliance with corporate progressive discipline policies, provides careful communication training to reduce potential legal exposure, formulates strategies for reductions in force, and regularly drafts non-competition, severance, and separation agreements. He regularly appears before the EEOC and state and local EEO agencies to advocate for clients in response to charges or complaints of discrimination. Mr. Roth works with in-house legal counsel and personnel departments to prepare position statements and produce other data designed to prevent potential lawsuits and he has extensive experience mediating and arbitrating workplace disputes.
