About Eric Werlinger

I help clients solve their toughest problems, both in court and out of court. I'm a generalist at heart, with deep experience in consumer finance litigation and intellectual property litigation. I started out as an appellate litigator, and it's still a big part of what I do. I've appeared in the U.S. Supreme Court and the majority of the U.S. Courts of Appeals. I'm particularly knowledgeable of the Federal Circuit, where I've briefed and argued numerous patent appeals on behalf of pharmaceutical companies, telecommunication innovators, and more. I've also litigated numerous class-action appeals, Rule 23(f) petitions, and arbitration appeals. Since joining Katten, I've handled scores of cases on behalf of retail banks and credit unions. Mostly consumer litigation: overdraft-fee class actions, FCRA and FDCPA suits, deceptive-trade practice claims, and TCPA suits. I leverage my appellate skills to end cases quickly using dispositive motions. If we go to discovery, I fight to keep it efficient and focused on the issues that actually matter. If it eventually makes sense to settle, I've guided numerous individual and class-action settlements. I also help banks and credit unions outside of court with regulatory, compliance, and investigative matters: Updating disclosures, implementing best practices, dealing with regulators, and other matters that help retail institutions best serve their customers and hopefully avoid litigation in the first place. Beyond these core areas, I also have experience in securities litigation, False Claims Act litigation, white collar defense, bankruptcy litigation, and other types of complex litigation.(Attorney Advertising.
