Direct PRA, LLC’s Delaware consumer collections practice: manage all litigation-related activities; create and audit internal policies, procedures and processes to promote efficiencies while mitigating risk; maintain awareness of relevant case law, legislation and government enforcement actions relating to consumer, credit and collections areas, including the FDCPA, TCPA, TILA, ECOA and FCRA. • Counseled national lenders, loan servicers, and debt purchasers on remedies for non-performing accounts, both unsecured and collateralized by real and personal property including JPMorgan Chase, Bank of America, Ocwen, and Select Portfolio Servicing. • Researched and drafted legal memoranda on federal and state debt collection regulations and best practices, consumer protection laws, and default remedies. • Represented creditors, debtors and bankruptcy trustees in chapter 7, 9, 11, 12 and 13 bankruptcy cases and adversary proceedings, from pre-filing to post-confirmation. • Conducted written and oral examinations of debtors in collection and bankruptcy matters. • Represented bankruptcy trustees regarding asset sales and turnover of estate property. • Negotiated and drafted commercial agreements including technology licenses, master services agreements, statements of work, maintenance and consulting agreements for clients including Cardinal Health, Elementis plc, and Order Execution Services. • Assisted in series of business process outsourcings, including the review and analysis of vendor contracts for AstraZeneca, Bristol-Myers Squibb, Lilly, and Colgate-Palmolive.
