Climate Law & Strategy The Global Climate Movement is in desperate need of conversation and partnership. Some climate voices scream that coal and oil must be left in the ground. Popular media cannot stop saying that if we stop burning fossil fuels, the climate will return to normal. Some now argue that past mining of coal to produce energy and electricity and extraction of oil to produce fuel oil, diesel and gasoline were conspiracies to heat the planet to extinction. These voices have convinced a large percentage of the people around the world that local GHG emissions have local impacts. Even the U.S. Supreme Court recognizes that GHG emissions are global. People cause climate change. The population of the planet is constantly growing exponentially and that will not change. First and second world countries with the highest populations are causing the most stress to the planet. But, we must act now. The climate is in crisis. Polar ice is melting. Oceans are rising. The world grows hotter every year. Energy and the generation, transmission, and delivery of electricity are the lifeblood of this country and the planet. If we can reduce GHGs now, future warming may be lowered. Industry expertise will reduce GHG emissions, but this work cannot be mandated. New natural gas generation, small scale nuclear, and improved renewables are essential. The cost of development, installation, and additional generation necessary for CCS and CCUS to operate successfully should be spent on advanced transmission grids and electricity storage. Climate Law & Strategy is focused on legal strategies to make global climate change efforts more effective. For better or worse, the Paris Agreement is the Climate Change Constitution and should be treated as such. The COP process is highly flawed and focused primarily on the transfer of funds to countries for adaption. The Article 6 carbon market work can create incentives to reduce GHGs. Answering the question of whether to sanction carbon markets at the individual country and regional levels is important. As many with emissions market experience are pointing out, making a carbon market a true market is almost impossible. Markets work because there is a constraint on amount of tradable commodites and enforceable rules to govern all aspects of the market. Problems of equivalency and leakage maybe unsolvable.
