About Jesse McClellan

Jesse W. McClellan, Esq. is a California attorney and former state sales and use tax field auditor specializing in sales and use tax matters. He has represented a wide array of business taxpayers across various states, including a variety of complex tax issues. Jesse has served as lead tax counsel in refund actions against state taxing agencies and provided expert witness services in both civil and criminal cases related to sales and use tax. He has also acted as special tax counsel in bankruptcy proceedings and has successfully resolved numerous administrative tax audits and appeals. Several of his cases before the California State Board of Equalization and the California Office of Tax Appeals have resulted in published precedential opinions.In addition to his casework, Jesse is a frequent writer and speaker on tax-related topics, having contributed articles and presented at numerous taxation seminars. He leads his firm’s efforts to initiate and draft new laws, regulations, and procedures aimed at protecting and advocating for taxpayers. Notably, Jesse initiated and led the effort to establish standard of proof guidelines for California’s audit staff, serving as the principal author of the published guidelines. Together with his founding partner, Dan Davis, Jesse co-authored a continuing education course on multistate sales and use tax nexus.Before co-founding McClellan Davis, LLC in 2007, Jesse worked as an internal auditor for a Fortune 500 company, where he ensured compliance at retail locations nationwide. He then served as a sales and use tax auditor for the California Department of Tax and Fee Administration (formerly the State Board of Equalization). After leaving the state, Jesse joined the predecessor firm to McClellan Davis, where he served as vice president and audit division lead consultant.
