Background
About John D. Finerty
John D. Finerty, Jr. is an AV rated trial lawyer and former Chairman of the Banking & Financial Services Practice Group at Michael Best & Friedrich. Currently serving as General Counsel and Director of Finance for a supply chain, logistics and manufacturing business seeking to grow internationally. As a leader in the Banking & Financial Services industry, I had oversight responsibility of a team of attorneys handling complex transactions and litigation that involve specifically commercial contract disputes, contested foreclosures, workouts and debt restructuring. I also have extensive experience in ERISA defense, corporate governance and D&O Liability claims, minority shareholder disputes, EPLI coverage claims, restrictive covenant litigation, including injunctions and TROs, theft of trade secrets, Lanham Act unfair competition cases and trademark defense, and labor consulting on mergers, acquisitions and bankruptcies. Some of the ground-breaking cases I have been first chair or co-counsel on include: In Re the Rehabilitation of the Segregated Account of Ambac Assurance Corp, Case No. 10-cv- 1576 (Dane Co. Cir. Ct.)(Jan. 22, 2018), in which I won court approval of a $5 Billion debt exchange transaction to facilitate a successful exit of the Segregated Account of Ambac Assurance Corp. from an insurance rehabilitation, the largest in Wisconsin history. Principle Solutions, LLC v. Feed.Ing BV, No. 13-C-223, 2014 WL 4954465 (E.D. Wis. Sept. 30, 2014), was a federal case in which the court granted summary judgment in a U.C.C. sale of goods case on a counterclaim for more than $12 million. In Joy Global, Inc. v. Wisconsin Department of Workforce Development, 739 F. Supp. 2d 711 (D. Del. 2010), I was co-chair of the trial team that successfully defended a $20 million benefit claim that arose out of the Chapter 11 reorganization of Harnischfeger Industries. Although my background emphasizes litigation, I bring pragmatism and a generalist skill set to every client engagement. I look forward to connecting with you.
