Kyle Foote is an environmental attorney, his practice includes representation of clients in matters arising under the federal and state laws regulating air, water, hazardous substances and wastes, and natural resources. Kyle advises clients on applicable regulatory requirements and proactive compliance strategies, as well as in response to notices of violation, and the negotiation of settlement agreements with the Environmental Protection Agency and state environmental agencies. A significant portion of Kyle’s practice is devoted to business and real estate transactions, and involves performing critical environmental due diligence analysis, obtaining construction and operating permits for facilities, and advising clients concerning liability exposure and risk mitigation strategies. Kyle’s practice also includes working closely with clients to plan and develop new environmental strategies and procedures, as well as conducting internal auditing to ensure proper and consistent implementation and compliance with environmental laws and permits. Kyle represents clients during on-site inspections and investigations by the Environmental Protection Agency and state environmental agencies, and he coordinates internal investigations and multi-facility responses to government investigations and requests for information under the various environmental laws. He works with environmental consultants to develop creative solutions to environmental problems, conducts oversight of the investigation and remediation of contaminated properties, and also works with state voluntary cleanup and insurance fund programs. Kyle works with clients in the following sectors: manufacturing, energy and electric utility, real estate (acquisition and development), mining, propane and petroleum storage and distribution, telecommunications, finance and banking.
