About Lori Wirkus

Lori McCarthy Wirkus is an accomplished litigator with more than 25 years of experience. As a Partner at Flynn|Wirkus, P.C. and Director of FW’s Medicare Compliance Group, Lori’s legal work concentrates on civil litigation, Medicare compliance, and recovery resolution. As a litigator, she handles all aspects of FW’s national litigation practice, trying cases, conducting and defending depositions, drafting pleadings, discovery and dispositive motions, attending mediations, and arguing motions in various state and federal courts. She serves as National Medicare Counsel for multiple insurers. Lori advises and counsels them throughout all phases of the Medicare Secondary Payer Process, including Section mandatory reporting, Medicare conditional payment/lien resolution, Medicare Advantage Plan lien resolution, systems auditing, training, Medicare set aside preparation and allowance. Lori is a certified mediator and frequently speaks to her peers, clients, and business and trade organizations on such matters as Medicare Set Asides, the use of technology at mediations and trial, general trial practice, trends and developments relating to sexual harassment claims in the workplace, such as defending against cutting-edge plaintiff lawyer tactics, law firm management case preparation, marketing skills and FRSA/OSHA Whistleblower law. She believes strongly in supporting and serving her community neighbors, especially those in the non-profit sector, such as the Franklin Performing Arts Company, THE BLACK BOX, Boston Chinatown Neighborhood Center, Cradles to Crayons and the Santa Foundation, where she happily volunteers her time and services. Lori is admitted to practice law in the state courts of Massachusetts, Connecticut, Pennsylvania, Ohio, as well as the United District Courts for the districts of Massachusetts, the Northern District of New York, the Eastern District of Pennsylvania and Vermont.
