About Mark Whiting

Mark is a partner in the regulatory team at Capsticks. Since qualifying in 2001, he has acted for a number of national healthcare regulatory bodies as well as acting for NHS bodies in their roles as local regulators. Mark currently leads the teams which investigate fitness to practise cases on behalf of the General Dental Council and Nursing & Midwifery Council, for whom he is the key contact partner. He has hands-on experience of conducting sensitive and complex cases, and he oversees statutory appeals and judicial reviews. Mark also provides advice to regulatory clients on a broad range of issues including the implementation of new policy and guidance, discrete areas of complex law and practice, statutory interpretation and ways to improve processes. Mark has led on the development and implementation of a bespoke case management system for our work for healthcare regulators. This enables us to deliver state of the art management information to monitor the progress of cases and has ensured that cases are prepared to meet and exceed contractual key performance indicators. Mark is rated in the field of professional discipline by the Legal 500 and the Chambers Guide to the Legal Profession. He is commended as having “an unparalleled knowledge of clients’ cases”. Sources also comment on his “phenomenal level of knowledge in complex cases” and that “he is able to absorb all the information and take the correct strategic approach”. He has also been a Committee Member of the Association of Regulatory and Disciplinary Lawyers for several years.
