About Matthew van Eman

I have helped clients obtain hundreds of US and foreign patents relating to medical devices, biomaterials, surgical instruments, pacemakers and defibrillators, diagnostic tools, regenerative medicine products, advanced wound treatments, complex delivery systems for small molecules and biologics, and various diagnostic and in vitro laboratory equipment. I have also drafted and prosecuted many patents related non-medical mechanical, electrical, and materials inventions. I regularly provide opinions and perform due diligence to support product development, new product launch, and technology licensing or acquisitions. This includes freedom-to-operate review prior to product launch or early in development, as well as buyer's due diligence before entering into potentially expensive deals. My counseling work also includes assessment of patent strength and validity to assist in patent or technology purchases, or to assist in pre-litigation diligence. My patent prosecution and counseling work is also informed by years of experience in numerous facets of district court litigation. This includes extensive involvement in early case assessment in preparation for plaintiffs’ filings, as well as assessment of defense strategies for assertion of non-infringement and invalidity positions. I have been involved in complex claim construction analysis and briefing, and have managed or assisted in numerous aspects of fact discovery, resolution of discovery disputes, product testing, and expert witness preparation. I assist Veterans in a number of pro bono matters including leading the firm's efforts at pro bono clinics at local VA hospitals and filings disability appeals to the Court of Appeals for Veterans Claims.*Attorney Advertisement
