About Michael Fortney

I am an attorney, arbitrator and mediator with expertise in construction law, employment and labor law, litigation, and business disputes. I have litigated and served as a neutral in hundreds of cases involving construction disputes, commercial business disputes, and employment disputes. Redgarding construction disputes, I represent of owners, general contractors and subcontractors and serve as a neutral in disputes involving contract formation, unforeseen and differing site conditions, scope of work, extra work, quality of work, timeliness of completion, delay, acceleration, liquidated damage claims, mechanic’s lien claims, and non-payment issues. I also represent parties and serve as a neutral in employment and labor disputes, including claims alleging age discrimination, race discrimination, sex harassment, disability discrimination, violation of state civil rights statutes, Title VII, the ADEA, the ADA, and the NLRA, cases alleging wrongful discharge, cases seeking the enforcement of non-competition agreements, small business ownership issues, and disputes between shareholders in closely held corporations. I also have extensive experience in alternate dispute resolution, serving as an arbitrator or mediator in disputes since 1995. I am a member of the ADR Federal Court Panel for the Northern District of Ohio, the panel of arbitrators for the American Arbitration Association, serving as an employment, construction and commercial arbitrator, a member and former Chair of the Construction Advisory Council of the and a member of the panel of arbitrators for FINRA (formerly the NASD). I have been an arbitrator and mediator for many employment, construction and business disputes, and have served as Arbitration Panel Chair for several large and complex cases. I am AV rated by Martindale Hubbell since 1994, signifying the highest standard of legal abilities and professional ethics and conduct.
