The goal of my practice is to assist risk managers, claims adjusters, product manufacturers, and business owners by promptly, comprehensively, transparently, and, most importantly, honestly, assessing claims. Through a consistent and dedicated approach, I work with my clients to efficiently close files. Being an effective counsel requires an open approach to claim analysis, including examination of strengths and weaknesses, and resultant valuation of the matter. Too often, civil defense attorneys receive a case assignment and immediately put their heads down and start billing the file, employing a rigid, formulaic style in the process. Conversely, I have always assessed each claim on its own merits, and set early deadlines for comprehensive exit strategy meetings with my clients. The results speak for themselves: in the instances which early resolution is advantageous, I have a long history of successful resolutions and satisfied clients. Undeniably, there are times when unrelenting, zealous advocacy is absolutely necessary. I am often reporting artificially inflated and outrageous initial demands from opposing counsel, to which I cannot recommend that my clients make a settlement offer. On other occasions, discovery is required in order to pursue the facts of the matter and drive down value. Engaging in litigation is necessary, and is often contentious and costly. However, I continue to set markers during litigation to reset, step back from the day-to-day grind of the process, specifically target my discovery initiatives, seek to confer with opposing counsel, and report to the client. The longest time period between any client reporting is 30 days, and it is often far less than that. I am constantly assessing liability, damages, valuation, and potential resolution of the matter. If your civil defense counsel is sending you monthly bills but not monthly reports on how to exit a case, you may need to reassess to whom you are sending your files.
