About Osker Linde

I have spent the last 18 years forging strong relationships between my clients and third parties such as the State Government, Mining and Energy Companies and Local Governments. I have represented several native title claim groups all the way through to a successful determination of native title through the Federal Court. I have successfully quashed Minister’s decisions through judicial review in the Supreme Court of South Australia. I have extensive experience in conducting meetings of up to two hundred people to deliver legal advice and obtain informed consent. I have negotiated complex tripartite land use agreements between my clients, the State and multinational development companies such as BHP Billiton. I have a sound understanding of contract law and have a strong history of corporate compliance in relation to Aboriginal Corporations. I negotiated the second ever compensation determination under the Native Title Act and have secured the two largest native title settlements in South Australia to date. I have a sound knowledge of mining, fisheries and aquaculture regulation and processes through my work for native title claimants. I appear regularly as a barrister and solicitor in the Federal Court of Australia and in the State Supreme Court and Environment Resources and Development Court. I know when to brief Counsel and I deliver succinct briefs to ensure low cost to my client. I am an enthusiastic worker who can take on new challenges as they arise and am not afraid to branch out into new areas of legal practice as required. I have also acted as a legal officer in a State Government Department so I have a strong understanding of Government processes. I have also acted as a criminal lawyer for Aboriginal Legal Rights Movement Port Augusta and my advocacy skills before the court started there. They have grown all the way to the Federal Court and I have also instructed Counsel In the High Court of Australia. I would welcome an opportunity to show case my skills. Most recently I advised in the negotiation and settling of a compensation liability of South Australia to the Narungga people of Yorke Peninsula on a whole of determination area basis, which will see tens of millions paid over to Narungga people very soon, to be held for the benefit of all common law holders past present and future.
