About Robert Whitaker

My practice is focused on representing employers in all aspects of state and federal employment law and commercial litigation. I regularly defend employers before state and federal agencies such as the EEOC, United States Department of Labor, NYS Department of Labor and NYS Division of Human Rights. I have extensive state and federal court litigation experience defending claims under the NYS Human Rights Law, Title VII, ADA, ADEA and USERRA as well as disputes regarding restrictive covenants. I also represent employers against unemployment insurance benefit claims, workers compensation discrimination claims and independent contractor status disputes (with particular focus on the trucking and construction industries). Additionally, I am experienced with enforcing copyrights in federal court on behalf of national and international musical composers, authors and lyricists. Before entering private practice, I served as a Defense Attorney for the Navy Judge Advocate General’s Corps (Navy JAG Corps), representing active duty military personnel in military federal courts throughout the southeastern United States. As a JAG, I also served as Deputy Staff Judge Advocate (e.g, Depute General Counsel) and prosecutor for the Commanding General of the 2d Marine Logistics Group in Al Anbar, Iraq.
