About Samuel Abernethy

I am a litigator and corporate lawyer who concentrates on the financial services industry, particularly commodities, derivatives and securities. Markets and trading are interesting to me and I have developed a deep understanding of the way financial markets work and how they can be abused. Having served as in-house counsel to two different exchanges (Comex and ICE, the former Coffee, Sugar & Cocoa Exchange), I have broad experience in commodities and derivative transactions, and bring a seasoned view of securities and corporate management. With decades in the profession, including a track record in litigation and investigations, I offer sound judgment in resolving a wide range of problems. I advise registrants in compliance matters and represent litigants in private disputes (as well as arbitrations and mediations) and regulatory disciplinary matters, including investigations. I also advise clients in corporate governance matters, shareholder/member rights and employment issues. I encourage clients to avoid litigation if at all possible, as it’s draining financially and psychologically, to say nothing of the time it takes away from their real business. But if litigation is inevitable, I am firm without being unnecessarily aggressive and commence each dispute with a strategy informed by a clear understanding of our adversary’s point of view. I serve as a receiver, arbitrator, and expert witness in commodities and derivatives-related matters and disputes. I take pride in being considered a thoughtful listener with sound judgment and a deep appreciation of the markets.
