Background

About Stuart Carson

As a Competition Litigation specialist, I have advised on some of the most complex and high-value competition damages claims in Europe, the breadth of which is extensive and includes particular expertise in relation to complex and innovative funding structures. I have acted for clients in the Supreme Court, Court of Appeal, High Court and Competition Appeal Tribunal, and have advised on global cartels involving Trucks, CRTs, LCDs, DRAMs, Smart Card Chips and Refrigeration Compressors, in addition to various other confidential matters. I also successfully acted against Mastercard in the Supreme Court, achieving a landmark decision in the high-profile Interchange Fee litigation. Before joining Stewarts, I gained valuable in-house experience, having previously worked as Litigation Counsel for one of the world’s largest energy companies, where I led various high-value and complex claims. As a firm, Stewarts specialises in high-value and complex disputes, and is the UK's leading litigation only law firm. Our Competition Litigation team acts in the most high-profile competition cases in the UK and Europe on behalf of major global corporates. A few of my notable cases include: • Asda, Argos and Morrisons v MasterCard & Ors [2020] UKSC 24: The Supreme Court confirmed that the fixing of interchange fees by MasterCard and its network members over many years was an unlawful infringement of competition law. The court found unequivocally in our clients’ favour, in what has been described as the largest and most complex cartel damages claim conducted in the English Courts to date - featured as A Top 20 case of 2014 and 2016 in the Lawyer, and a Top Appeal case of 2020 in the Lawyer. • iiyama Benelux BV and Ors v Schott AG and Ors, and iiyama (UK) Limited & Ors. v Samsung Electronics Co. Ltd & Ors: Acted for iiyama, one of the world's largest global electronics manufacturers, in two separate cartel damages claims concerning CRTs and LCDs respectively. Our client successfully defended jurisdiction challenges in the Court of Appeal, changing the territorial scope of such claims in the English courts. • Re Comet Group Ltd (in liquidation); Khan & Ors v Whirlpool (UK) Ltd & Ors: Successful application for disclosure in a cartel damages claim pursuant to the Insolvency Act 1986 section 236, a purpose for which s236 had not been used before. • GDF Suez & Ors v Teesside Power Holdings & Ors (Top 20 case of 2013 - the Lawyer): Following the purchase of a UK power station, the claimants claimed over £100m for a number of alleged breaches of warranty.
