About Stuart Lowe

I am an experienced property lawyer with particular expertise in retirement villages. I have a detailed knowledge of the law relating to this highly regulated industry in Queensland, particularly the Retirement Villages Act This includes: • establishing new villages, including preparing the Public Information Document and residence contract and registering the scheme; • conducting extensive reviews of operators’ existing template documents, in response to both legislative changes and changes in their business models; • advising operators on the introduction of care services as a central component of their business models, including revising their templates and advising on compliance issues; • acting in the sale and acquisition of several retirement villages, aged care facilities and seniors rental accommodation, including the divestment of a portfolio of 8 facilities for more than $200 million; • undertaking transactional work in respect of residence contracts between operators and residents; and • advising on appropriate action in response to disputes with residents, including preparing correspondence, advising on strategy and Queensland Civil and Administrative Tribunal appearances. As an active member of the Retirement Living Committee for industry peak body Leading Age Services Australia, I am at the forefront of developments in this industry. My role on this committee allows me to assist industry formulate its responses to Government in respect of legislative reviews. I have also delivered several presentations to their Retirement Living Symposium and am a preferred lawyer for the referral of retirement village matters by the Queensland Law Society. Based on my extensive property law experience, I also advise clients on property development, sales and acquisitions of commercial, industrial, retail and residential properties, commercial and retail leasing and compulsory acquisitions.
