About Vivek Agarwal

Vivek Agarwal heads the Competition Law Practice of DMD Advocates. He is a seasoned antitrust lawyer and has been working closely with the Competition Commission of India (CCI) and the Indian Government with the drafting of the CCI Regulations, including the merger control (combination) regulations. He represents companies across the full spectrum of competition law issues. He has been a part of many key antitrust enforcement and combination cases. He also takes up industry issues with the Government as the Co-Chair of the competition law committee at the PHD Chamber of Commerce and Industry. Vivek has worked on some of the most complex combination cases, including the ones involving structural/ behavioural remedies. He advises on M&A structures, PE transactions, CCI merger filing requirements and gun jumping risks. He has been engaged in various high profile enforcement cases (cartel and dominance), including leniency petitions. Vivek also focuses on vertical agreements and competition compliance programmes. He advises on potential competition risks with dealer/ distributor/ supply/ procurement agreements, imposition of vertical restraints and actual market conduct with business partners. Vivek obtained his Master of Laws, with a special focus on competition law, at King’s College London. He trained in competition law at the Brussels and London offices of Linklaters LLP and worked with the competition law department of Tesco Plc, London. Prior to joining DMD Advocates, Vivek worked with Shardul Amarchand Mangaldas & Co, New Delhi. He has consistently been recognised as a global elite ‘Thought Leader' in competition law by Who’s Who Legal, London. He was nominated for the best business article for the 2021 Antitrust Writing Awards by Concurrences, New York, and George Washington University. Vivek is the only practitioner from India to win the Lexology Client Choice Award 2021 and 2022 (Competition Law) for exceptional client care and quality of service. He has been recognised as the Future Legal Leader by the India Business Law Journal. He conducts seminars on competition law at various law schools and industry forums. Vivek is a member of the (Indian) Supreme Court Bar Association, Delhi High Court Bar Association and the Antitrust Section of the International Bar Association.
