The easement created value and made the home more desirable as the future occupant will have access to use the lake even though they do not own lake frontage. The easement was purchased from an owner who has since sold the property that owns the lake frontage. My clients have stored their dock and lift on the shoreline in the winter for several years but the current owners may try to stop this from happening in the future. In disclosing the easement to potential purchasers the owners and I decided to have their real estate attorney amend the standard disclosure statement from the Board of Realtors and create a new document explaining the situation. The property has since sold and my clients are happy and satisfied that they have represented their home and easement to the best of their ability. They were able to lease this home when real estate values were down and have now sold the home after the tenants moved out and the market has recovered.
