About Stephen Birman
I am a partner at Thomson Rogers. I graduated from the University of Toronto law school in 2007 and joined Thomson, Rogers in 2009, where my practice focuses largely on personal injury litigation, long-term disability and class action litigation. I pursue claims against insurance companies on behalf of my clients. I am most proud of a recent success for my client in a 5-week jury trial (Baker v. Blue Cross) over long-term disability benefits in the Ontario Superior Court. This was a David v. Goliath type of dispute that ended with my client successful on all issues and with the jury making the largest known punitive and aggravated damages awards against an insurance company in Canada. The decision was recently upheld by the Ontario Court of Appeal. I am motivated by helping vulnerable clients pursue class action litigation as well. I spent the first 3 years of my career working with residential school survivors and helped survivors advance compensation claims under Canada’s largest class action settlement. I have been involved in numerous other class actions and am currently part of the Thomson, Rogers team pursuing claims arising out of alleged nursing home negligence and business interruption losses during the COVID-19 pandemic as well as significant claims regarding a global recall of CPAP medical devices. I pride myself on my ability to help clients understand and feel informed, focused on the goal, and in control throughout the various stages of the litigation process. I am a Certified Litigation Specialist as recognized by the Law Society of Ontario. I have been recognized as a leading lawyer in the Canadian Legal Lexpert Directory and by Best Lawyers. I have earned the highest peer rating of AV Preeminent® in Martindale-Hubbell® for my legal expertise, communication skills, and ethical standards. In 2024, I completed the intensive mediation program at Harvard Law School. I have recently been nominated by Canadian Lawyer Magazine as one of Canada's most influential lawyers for 2024.
